Ownership of the website

www.cnjc.cat is a website. The domain name is registered and it is the property of the National Youth Council of Catalonia (hereinafter also the NYCC), a public association-based organisation with its own legal status, with registered offices in Pl. de Cardona, 1-2, 1r (08006) Barcelona and holder of Tax Identification Number G-08678831.

The purpose of www.cnjc.cat is to report on the NYCC’s activity, which corresponds to the platform that comprises almost one hundred youth organisations of Catalonia and local youth councils. It promotes the interests of young people in society and vis-à-vis the public authorities, as well as its products and services, offers, promotions and other relevant information about the  NYCC.

Access to www.cnjc.cat is free. By using this website you accept the information contained in this Legal Notice.

The user’s obligations

By accessing the website www.cnjc.cat, the user undertakes to use its information and contents in accordance with this Legal Notice, the applicable legislation and generally accepted good customs and public order, and more particularly:

a) To act honestly and in good faith in all their dealings with the NYCC.
b) To provide true and accurate data in the course of their contractual relationship with the NYCC.

Responsibility

The NYCC may not be held responsible for any damages derived from incorrect operation of the computer networks that provide access to  www.cnjc.cat, nor for any possible interruptions in access, viruses, connections and the operating systems that provide access to the Internet. Similarly, neither may the NYCC be held responsible for any damages derived from illegal and unlawful actions by third parties beyond its control in the transmission of data through computer networks.

The information contained on this website may not always be up to date. In this case, the NYCC will not be responsible for any damages derived from external use and/or use of the information provided by third parties. 

The NYCC reserves the right to temporarily suspend access to the website when necessary, without the need to give notice, and also to perform any necessary maintenance and updating actions.

The contents (including, albeit not exclusively, texts, logotypes, images, drawings, web design, brands, source code and software) of the website  www.cnjc.cat are protected by the applicable industrial and intellectual property legislation and any other applicable regulation. The legitimate exploitation of the aforementioned contents corresponds exclusively to the NYCC or to its licensors, and total or partial reproduction and/or distribution of any type of content by the user and/or third parties is totally prohibited without the express authorisation of the NYCC authorising or permitting such dissemination.

Under no circumstances does accessing the website  www.cnjc.cat involve permission, transmission, licencing or total or partial assignment of the aforementioned rights by their owners or of any other right of use, modification, exploitation, reproduction, distribution or public communication unless expressly authorised otherwise by the NYCC.

The content of this Legal Notice and any of the privacy policies, cookies or applicable sectoral standards are governed by the Spanish laws in force at all times. In the event of a dispute or controversy, the parties agree to abide by the jurisdiction of the competent courts and tribunals. If the parties deem it necessary to have recourse to alternative systems for the resolution of controversies, such as arbitration or mediation, this must be proposed and expressly accepted, in writing, at the time the controversy arises, and always based on the provisions of the applicable legislation.

 

2.WEBSITE: PRIVACY POLICY. 

This privacy policy (“Privacy Policy”) describes how the National Youth Council of Catalonia (hereinafter also the NYCC) gathers, processes and uses the personal information of its clients and users, always subject to its commitment to the privacy and security of the information of the data, which are collected exclusively for determined, explicit and legitimate purposes, and which may not be processed in any fashion that is inconsistent with such purposes, and always in strict fulfilment of the applicable personal data protection regulations, more particularly the General Data Protection Regulation (EU) 679/2016 (hereinafter the GDPR) and the Organic Law 3/2018 on Personal Data Protection and the Guarantee of Digital Rights (hereinafter the LOPDGDD).

The Privacy Policy will be updated periodically with a view to clarifying or reflecting any new practices in the management of the privacy of our users or any legislative, jurisprudential or interpretation modifications of the Spanish Data Protection Agency or other oversight authorities that may take place or may have to be applied and will be accessible for reference purposes at all times from the website www.cnjc.cat.

The NYCC processes your personal data fulfilling the principles provided for in the applicable regulations and more particularly in the GDPR and the LOPDGDD. Personal data will not  be used for purposes other than the ones expounded below:
 

  • Web users’ data:

The browsing data of web users will be processed solely for statistical and analytical purposes in accordance with the provisions of our cookies policy, as well as to provide information about our business activity and, as the case may be, to attend to their queries and suggestions.

In this regard, we may process data such as the IP used to access the telecommunications network, data from municipalities from which the website is access, Operating System and browser used by the user, pages visited and connection time.

  • Data collected through the contact forms:

We may also process personal data if the data subjects send us queries, complaints or suggestions through the contact forms provided for these purposes on our website for the sole purpose of attending to the request. Under no circumstances will these data be entered into other databases or will we send commercial communications by email without the data subject’s prior authorisation.

The compulsory data of each form will be identified as such. If these data are not provided or are incorrect, the NYCC will not be able to identify it properly and the register will consequently be deleted from the registry. 

  • Data of emails received:

We will also process personal data if the data subjects submit queries, complaints or suggestions by email to the address provided on the website for such purposes. In such cases, the data will be processed for the sole purpose of catering to the request involved. Under no circumstances will these data be entered into other databases or will we send commercial communications by email without the data subject’s prior authorisation.

  • Subscription to our newsletter:

Users may subscribe to our newsletter by completing the data on the registration form provided on the website www.cnjc.cat. The data of the subscribers to the newsletter will be processed for the sole purpose of sending information about the NYCC’s activity, as well as to provide information about new developments, promotions, organised events or discounts applicable to our products or services based on their prior consent.

Subscribers may cancel their subscription to the newsletter at any time by accessing the unsubscribe procedure at the foot of each newsletter or by writing to  [email protected]

  • Data pertaining to the loan of space:

The data of users who request the loan of space from the NYCC on the form will be processed for the purpose of rendering the loan-of-space services, as well as for the purpose of administrative management based on the collaboration relationship between the parties that constitutes the authorisation for data processing.

  •  Data for registration on courses or activities:

The data of anyone who registers to participate in the training courses or activities organised by the NYCC will be processed for the purpose of rendering the training services or the organisation of the activity requested, as well as for taxation, accounting and administrative invoicing pertaining to the contractual relationship that constitutes the authorisation for data processing.

  • CV data:

Similarly, we may process  curriculum vitae data if the data subjects send them to us by email or via the form provided in the “Work with us” section. In such cases, the data will be processed for the sole purpose of participating in present or future active recruitment processes.

  • Data collected through our Social Media profiles:

We may process the data of social media users who interact with the NYCC profile page on the different social media.

Specific clauses for the social media

Facebook
By pressing the “Like” button of this social medium, the user provides their consent for NYCC, in fulfilment of Facebook’s conditions of use and privacy policy, to be able to access its followers’ personal data, publish news and information that will appear on their walls and send messages. Under no circumstances will the NYCC use the data for purposes other than the ones described above. The user may stop following the NYCC at any time by clicking the “Unlike” button.

Twitter
By pressing the “Follow” button of this social medium, the user provides their consent for NYCC, in fulfilment of Twitter’s conditions of use and privacy policy, to be able to access its followers’ personal data, publish news and information that will appear on their Timeline, retweet tweets of followers and send messages. Under no circumstances will the NYCC use the data for purposes other than the ones described above. The user may stop being a follower at any time by clicking the “Unfollow” button.

Instagram
By following our profile, the user provides their consent for the NYCC, in fulfilment of Instagram’s conditions of use and privacy policy, to be able to access its followers’ personal data (name and photograph) and publish news that will appear on their home page. Under no circumstances will the NYCC use the data for purposes other than the ones described above. The user may stop being a follower at any time by clicking the “Unfollow” button.

YouTube
By following our channel, the user provides their acceptance for NYCC, in fulfilment of YouTube’s conditions of use and privacy policy, to be able to access its followers’ personal data (name and photograph) and to publish news that will appear on their home page. Under no circumstances will the NYCC use the data for purposes other than the ones described above. The user may stop being a follower at any time by clicking the “Unsubscribe” button.

The information provided by the NYCC in its social media profiles is purely for information purposes. The NYCC will not be responsible for any errors contained or for any damages derived from the use thereof.

With regard to modifying your data on a social medium, you are hereby informed that in using a platform alien to NYCC you can change each one of your profiles on the different social media in your profile settings. NYCC can only consult or delete your data as a follower.

Who do we disclose your data to:

The NYCC guarantees the confidentiality of your personal data, which will not be disclosed to third parties without the owner’s prior authorisation. Notwithstanding the foregoing, and depending on the NYCC’s different needs, we may disclose the data to the following recipients:

Service providers
The NYCC may have hired different services with suppliers who will have access to personal data. All the suppliers have entered into personal data processing agreements restricting processing to the purposes of the service rendered and always with the security measures provided for by the regulations in force.

Virtual payment platform:
If you make an online payment for the provision of services by us, we will report your data to Formfy.com, a tool owned by Doblemente S.L., a company from Alicante with Tax Identification Number B-53698445.

Public administration and authorities:
We may disclose your data and any other information in our possession or which may be accessible through our systems and is required in accordance with the legal and regulatory provisions applicable to the case to the public administration with powers in the matter, as well as to the competent public authorities. The foregoing is by legal mandate and is for the sole purpose of fulfilling our obligations and for preventing abuses of the services or fraudulent activities in the services provided through our Website.

International data transfer:

Your data may also be processed in countries outside the European Union. In such an eventuality, the NYCC will take measures to ensure that the countries receiving your personal data always have a similar and/or adequate level of protection. In any event, any international data transfers will be performed in accordance with the provisions of articles 44 et seq. of the GDPR.

Similarly, and if the international data transfer corresponds to the provision of a service to the NYCC, any such service will fulfil the provisions established in article 28 of the GDPR and art. 33 of the LOPDGDD, and the relevant data processing agreement will be entered into.

Exercise of rights:

Protection of rights before the Supervisory Authority:

In the event of the infringement of their right to personal data protection, the user may contact the corresponding National Supervisory Authority, the Spanish Data Protection Agency (www.agpd.es) or else the Catalan Data Protection Authority, (http://apdcat.gencat.cat/ca/inici), to initiate the relevant formalities to claim and/or defend their rights.

Data retention:

The data pertaining to members of the organisation, loans of space and registration for training, will be retained for the time required to attend to the purpose for which they were collected and for any legal obligations derived therefrom and, in any event, following the end of the business relationship, for a maximum term of 5 years. The financial data will be retained for the purposes provided for by Law 58/2003, the General Tax Law.

The data pertaining to queries put by users via the web forms, those received by email or chatbot, as well as curriculum vitae data, will be retained for a maximum period of one year as of the date on which they were collected.

The data collected through cookies, social media plug-ins and the browsing data of web users, will be retained for a maximum term of one year as of the date on which they were collected.

The data of newsletter subscribers will be retained until the subscriber requests cancellation of the subscription, the subscription email account ceases to operate or the client no longer wishes to receive the newsletter.

The data of users who access a social medium of the NYCC will not be added to the company’s databases and will therefore be retained in the conditions and for the period of time provided for by the corresponding social medium.

The user guarantees that they are an adult and that they have sufficient capacity and the necessary knowledge to use this website  www.cnjc.cat and its content, guaranteeing that the information they provide in each one of the forms in which the NYCC requests their personal data are true, undertaking to inform the NYCC of any change and/or modification in their data so that they may be processed correctly.

The NYCC has implemented the necessary security measures to guarantee effective use and processing of the personal data provided by the user, protecting the privacy, confidentiality and integrity thereof, in fulfilment of the applicable regulatory requirements and availing itself of the necessary technical resources to prevent any alteration, loss, unauthorised access or processing of their data, according to the state of the art at all times, and also within the control of the  NYCC.
